15 July 2024 at 12.01am AEST to 21 July 2024 at 11.59pm AEST

Item 3. Entry

To enter, individuals must complete the following steps during the Promotional Period:

1. visit http://www.digitalsurge.com.au (Platform) and create an account, if they do not already have a Platform account; and
2. follow the prompts to complete a trade of at least AU$100 on the Platform.

For each AU$100 traded on the Platform during the Promotional Period, one (1) entry will be received.

Terms and Conditions

1. Digital Surge Pty Ltd ACN 620 473 109 of Level 18, 324 Queen Street, Brisbane QLD 4000 (Promoter) is running a promotion called ‘Digital Surge’s 7th Birthday Promotion’ (Promotion) in accordance with these terms and conditions.
2. The Promotion commences on 15 July 2024 at 12.01am AEST and finishes on 21 July 2024 at 11.59pm AEST (Promotional Period).
3. By entering the Promotion, entrants are deemed to have read and agree to these Terms and Conditions (including the Schedule). Capitalised terms in these Terms and Conditions have the meaning given in the Schedule, unless otherwise specified.
4. Entries received outside the Promotional Period will not be accepted. The Promoter’s records are conclusive evidence as to the time of receipt of an entry.
5. Australian residents aged 16+ are eligible to enter. If an entrant is under the age of 18 years, parent or guardian consent to enter is required and the parent or guardian must read and consent to these terms.
6. Employees of the Promoter and their immediate families, and agencies associated with the Promotion cannot enter. ‘Immediate family’ means a spouse, ex-spouse, de-facto spouse, child or step-child (natural or adopted), parent, step-parent, grandparent, step-grandparent, brother, sister, step-brother, step-sister, uncle, aunt, niece, nephew, or first cousin.
7. The Promoter may, at any time, take steps to verify entries and entrants and reserves the right to disqualify any entrants who it believes, in its sole discretion, to have breached these Terms and Condition or otherwise engaged in any conduct which would risk the fair conduct of the Promotion.
8. Individuals may enter the Promotion using the entry method specified in the “Entry” section of the Schedule.
9. Unlimited entries per person, per day are permitted.
10. There will be one (1) draw conducted for the entries received each day of the Promotional Period, for a total of seven (7) draws (Daily Draws).
11. A Daily Draw to determine a winner will take place at Level 18, 324 Queen Street, Brisbane QLD 4000 on the following dates and times using computerised random selection:
    (a) 16 July 2024 at 12pm AEST;
    (b) 17 July 2024 at 12pm AEST;
    (c) 18 July 2024 at 12pm AEST;
    (d) 19 July 2024 at 12pm AEST;
    (e) 20 July 2024 at 12pm AEST;
    (f) 21 July 2024 at 12pm AEST; and
    (g) 22 July 2024 at 12pm AEST.
12. Daily Draws for weekends and public holidays will take place the next business day.
13. The winner of the Daily Draws is determined by chance.
14. Non-winning entries in each Daily Draw will not be entered into any subsequent Daily Draw.
15. The first valid entry drawn in each Daily Draw will be the winner of the prize for that day. The Promoter may draw reserve winners in case of ineligible or invalid entries. If a winner chooses is unwilling or unable to accept the Prize they forfeit the prize and the Promoter is not obliged to substitute the prize.
16. Prizes must be claimed by 22 October 2024 at 9am AEST. In the event of an unclaimed Prize, that prize will be redrawn at 9am AEST on 23 October 2024 at Level 18, 324 Queen Street, Brisbane QLD 4000. The winner(s) of the redraw will be notified in writing within 7 days of the draw and their details (first name, last name and post code) will be published at https://blog.digitalsurge.com.au by 22 November 2024. If there are no prize winners for this Promotion, this information will be published at https://blog.digitalsurge.com.au.
17. The Prize is subject always to the Platform terms and conditions at https://digitalsurge.com.au/terms.
18. The Prize is not exchangeable nor transferable.
19. The cost of the product or service on the Platform to enter is no greater than the cost would be without the opportunity to participate in the Promotion.
20. Each prize will be awarded to the owner of the Platform account who received the entry.
21. The Promoter is permitted to publish the winners’ first name, last name and postcode of residence.
22. If for any reason any aspect of this Promotion is not capable of running as planned, including by reason of computer virus, communications network failure, bugs, tampering, unauthorised intervention, fraud, technical failure or any cause beyond the control of the Promoter, the Promoter may in its sole discretion cancel, terminate, modify or suspend the Promotion and invalidate any affected entries, or suspend or modify a prize, subject to State or Territory regulation.
23. No entry fee is charged to enter the Promotion. There is no additional cost to enter the Promotion other than any cost paid by the entrant to their Internet service provider to access the Platform. Any costs associated with accessing the Platform is the entrant’s responsibility and is dependent on the internet service provider used.
24. The use of any automated entry software or any other mechanical or electronic means that allows an entrant to automatically enter repeatedly is prohibited and will render all entries for that entrant to be invalid.
25. The Promoter accepts no liability for any tax arising out of participation in the Promotion or acceptance of the Prize. Tax implications arising out of participation int the Promotion or acceptance of a Prize are the sole responsibility of the applicable entrant. Individuals should seek independent financial advice in relation to this.
26. Nothing in these Terms and Conditions limits, excludes or modifies or purports to limit, exclude or modify the statutory consumer guarantees provided under any applicable law, including the Competition and Consumer Act 2010 (Cth).
27. The Promoter (including its respective officers, employees, agents, and associated companies) is not responsible for and excludes all liability for any loss (including, without limitation, any indirect, special or consequential loss), claim, expense, damage, personal injury, death or property damage arising (directly or indirectly) in relation to the Promotion, or the acceptance or use of any Prize.
28. The Promoter collects all personal information in accordance with its privacy policy at https://digitalsurge.com.au/privacy (Privacy Policy) and in order to conduct the Promotion, may disclose such personal information to third parties, including but not limited to service providers and Australian regulatory authorities. The Privacy Policy contains information about how entrants can make a complaint in relation to privacy and how those complaints will be dealt with.
29. The laws of Queensland apply to this promotion to the exclusion of any other law. Entrants submit to the exclusive jurisdiction to the courts of Queensland.
30. The Promoter’s failure to enforce any of its rights does not constitute a waiver of those rights.
